UPDATE ON
SEVERANCE PAY ARBITRATION

TO ALL MEMBERS OF FORMER IAMAW LOCAL LODGE 1579

The arbitration was scheduled for December 16, 17 and 18, 2009.

Leading up to these dates it was decided through the preliminary discussions between the arbitrator, our legal counsel Dave Mercer and the company legal counsel to present written agreed facts regarding the issues to be argued.  These written facts were presented to the arbitrator on December 16, 2009 with the date of January 8, 2010 set for arguments to the facts.

Mr. Dave Mercer did an excellent job presenting our case to the arbitrator, which basically is that the company did not pay enough severance pay.

The company also presented their side, which basically is that the employees of L-3 are not terminated, but on layoff with recall rights.

We object to this position as there is no longer a shop to be recalled to since the company closed the operation, sold all of the equipment and shipped the remaining work to various sites in North America..

The decision is now in the arbitrator's hands.  There is no time limit for him to reach his decision, but normally we should hear something in a couple of months.

Thank you to those who attended the hearings.  I believe it helped for the arbitrator to see the real harm done by L-3's decision.
